Romanian Online Gaming Bill Draws Ire of European Commission

Romania Online PokerThe Romanian government recently introduced draft legislation to regulate online gaming and betting. After review of the regulation, the European Commission objected to some of the provisions in the proposed law. Romania will not be allowed to pass the law with its current provisions. The provisions the European Commission objected to were the following:

  • The prohibition of EU companies from marketing and advertising if they are not licensed by the Romanian government.
  • The requirement of servers to be located in Romania.
  • The requirement of EU licensed companies to be domiciled in Romania.
  • The exclusion of online pool betting while all other forms of online gambling would be allowed.


The European Gaming and Betting Association applauded the actions of the European Commission's ruling, “While we support Romania’s legitimate wish to regulate its online gaming market, it is important from a consumer protection perspective that national gambling policies are consistent. As confirmed by the ECJ in its recent rulings, there are less restrictive means than forced establishment to monitor and control the online gaming and betting market.”

Romanian officials can't adopt their legislation until November 3rd. If they adopt it the legislation in its current form the European Commission could launch infringement proceedings against the Romanian government.
