Judge Threatens Deliverance Poker With Civil Contempt

Mizrachi Poker DeliveranceIn a case that never seems to go a few days without something new happening, Judge James Nowlin of the US District Court for the Western District of Texas threatened Deliverance Poker with civil contempt in it’s lawsuit against Michael ‘The Grinder’ Mizrachi. Judge Nowlin identified several steps that must be completed before the preliminary injunction hearing scheduled for November 9th. That is the day after the WSOP Main Event final table is scheduled to wrap-up.

As a refresher to the case, the lawsuit states that Mizrachi was under contract to wear Deliverance Poker logos exclusively during public appearances and tournaments, including the 2010 WSOP Main Event. The contract also states Mizrachi granted Deliverance exclusive rights to his name, voice and likeness The lawsuit was filed to recover lost earnings, profits and earning capacity.

One of several steps required by Judge Nowlin is to provide Tiltware LLC (the owners of Full Tilt) and Mizrachi several documents in the case. In a response from the lawyers for Deliverance Poker they indicated that it was an “accidental oversight” that documents were not properly delivered. All documentation must be delivered by October 19th and filed with the court in order to have the preliminary junction hearing on November 9th.

What remains to be seen is if Deliverance is victorious with their injunction what it would actually mean. The final table would already be completed. The only thing that would remain is possible monetary compensation Deliverance could receive. Based on the case as it has unfolded, don’t look for Deliverance to win their case.
