Online Gaming is (Legally) Coming to Denmark

Denmark PokerAfter a lengthy court battle, last week the European Commission made a ruling that will allow foreign gaming companies to legally operate in the country of Denmark.

A direct result of the ruling is that beginning on January 1st, 2012, gaming companies from outside Denmark will be permitted to operate legally with the requirement that they obtain a business license and pay a 20% tax on gross earnings.

For over 50 years Danske Spil, which is 80% owned by the Danish government, has had exclusive rights to gambling in the country. Of course the word exclusive is not exactly appropriate, as foreign sites have been operating illegally in the country since the early 2000’s.

The wording of the ruling will allow the Danish government to pursue litigation against companies that fail to obtain proper licensing. Failure to comply with the licensing regulations could also lead to a countrywide block on websites that operate illegally within the country.
