Delaware Online Gambling Laws - Is Poker Legal?

Poker LawsOnline poker in Delaware is now fully legal. Delaware was the second state to legislate and regulate online poker. This happened when the Delaware Gaming Competitiveness Act of 2012 was passed. All poker players must be physically located within the state to play.

Unfortunately for non-Americans visiting the state, a social security number must also be provided for the state-regulated rooms.  However, some rooms, such as Americas Cardroom and Carbon Poker do not require the extra identification.

Regulation and Taxes for Online Poker in Delaware

  • Status of regulation: Not regulated in the United States and Delaware.
  • Tax on Players: 0-46.2%. You are taxed on your poker winnings at the Federal and State levels. Federal taxes can be up to 39.6% at the highest level. Delaware has a 2.2% to 6.6% progressive state income tax rate.
  • Segregation: None - Delaware players share tables with players in other states and countries in the same combined player pool.
