Even in Florida, which has bizarre gambling laws, real money poker is legal (for some limits). In fact, I can drive 20 minutes and find myself in a state run card-room with dozens of players and thousands on the tables. Surely, if this was illegal, someone should mention it to the officer (or officers) on the property. Private games are also legal, up to a certain limit. The limit happens to be very low for private games and few play that low... but it's possible to play that low. And, after a failed enforcement (from a public relations standpoint) Florida doesn't seen very interested in busting games unless they're openly flaunting the law.
So, the existence of money in the game -- by itself -- doesn't make it illegal. Not in my state. And no online according to the laws that effect me.
Money makes people addicts? That's just the dumbest thing I've ever heard come out of anyone's mouth. There are compulsive gamblers... regardless of game. And they find their own ways to get action. I play with a lot of people and very few would be those I consider compulsive gamblers. And the ones with a problem are pretty obvious.
As for the losing money thing... bankroll management and a decent skill level reduce that chance dramatically. And proper play will keep you from getting your money in bad so you're making money and taking the right side of the bet most of the time.
The tax on my day job is very high too... I suppose I should quit.
